Topamax (generic topiramate) is a medication used to treat epilepsy, a neurological disorder characterized by recurrent, uncontrolled seizures. The epilepsy drug Topamax is also prescribed by doctors to treat patients with migraine headaches and bipolar disorder. Scientists have recently concluded that children whose mothers took Topamax while pregnant are more likely to be born with a cleft lip, cleft palate, genital deformities and other fetal or skeletal birth defects than mothers who took other epilepsy drugs. Pregnant women who take Topamax during pregnancy may also have an increased risk of having a baby with other congenital birth defects, such as spinal bifida.
Our experienced product liability lawyers are holding Topamax’s manufacturer, Ortho-McNeil Neurologics and Noramco, Inc., both subsidiaries of Johnson & Johnson, accountable by filing Topamax birth defect lawsuits on behalf of Topamax victims whose baby was born with a cleft lip, cleft palate, spina bifida, genital deformity or other fetal and skeletal deformities. We represent every Topamax lawsuit client on a contingent fee basis, meaning there are absolutely no legal fees or costs unless you recover money.

According to recent data from the North American Antiepileptic Drug Pregnancy Registry, babies exposed to Topamax during the first trimester of pregnancy may have an increased risk of being born with an oral cleft birth defect such as cleft lip or cleft palate. The data suggests that women who use Topamax during the first trimester of their pregnancy are more than twenty-one (21) times more likely to give birth to a baby with a cleft lip or cleft palate than women who did not take Topamax. Additionally, pregnant Topamax users were three (3) times more likely to have a baby with a cleft lip or cleft palate than users of other anti-seizure epilepsy drugs.
In addition to an increased risk of having a child born with a cleft lip or cleft palate birth defect, pregnant women who took Topamax during their pregnancy may also have children who suffer from other congenital birth defects. These birth defects include spina bifida, genital birth defects, limb malformations, persistent pulmonary hypertension of the newborn (PPHN) and neural tube defects.
Not yet. However, in March 2011, the FDA issued a warning that mothers who took the epilepsy drug, Topamax or generic topiramate, while pregnant may have a higher risk of giving birth to a baby with a cleft lip or cleft palate. Unfortunately, due to inadequate warnings before the March 2011 FDA warning, many pregnant women had no idea about these serious Topamax birth defect risks.
In addition to the Topamax warning, the FDA also upgraded Topamax from a Pregnancy Category C to a Pregnancy Category D, which means Topamax has a proven risk of causing birth defects. Because cleft lip and cleft palate birth defects associated with Topamax occur early in a pregnancy, the FDA has also advised women of childbearing age who are taking Topamax to speak with their doctor about the benefits and risk of taking Topamax and whether alternative treatment options should be considered that carry a lower risk of congenital birth defects.
Johnson & Johnson has not announced any plans to issue a Topamax recall in the wake of the FDA’s birth defects warning.
