A BDK client sustained serious injuries when he was forced to make an emergency maneuver on his motorcycle, because the Defendant stopped in his lane while attempting to make a left turn out of a shopping center. Our client and his motorcycle flipped over and catapulted him into the defendant’s vehicle. The insurance company only offered $125,000.00, forcing our office to file a lawsuit.
The Defendant stated that he had crossed two lanes, waited in the median, and made a left into northbound traffic. BDK Attorney Lou Battista, upon researching the case with our crash expert, discovered that the Defendant was being untruthful, and actually stopped his vehicle in our client’s lane of travel instead of pulling into the median.
We were able to get the Defendant to admit in deposition that he stopped in the travel lane, was unaware that there was a median to pull into, and acknowledged the inconsistency with his prior sworn statement. Our client had a spinal and pelvis injury requiring surgery. He was out of work for three years. The nature of these injuries, the future impact they would have on our client’s life and his future earnings, along with the testimony of the Defendant were all significant factors in the Defendant’s decision to settle this case for the available policy limits.
