Many people are suffering nationwide as a result of damages that have been caused to their bodies from being implanted with a defective hip. These defects have caused a myriad of injuries to our clients including, metalosis, loss of bone, permanent tissue and muscle damage, femur fractures and other permanent injuries due to these patients requiring revision surgery to take out these defective and poisonous products.
BDK has taken a vanguard role in litigating defective hip cases locally and nationwide since 2008. Jesse Bernheim has served in a court appointed position, State Court Liasion counsel, of the Plaintiff’s Executive Counsel Committee for MDL 2441 In re Stryker Rejuvenate and ABGII Hip Implant Products Liability Litigation since 2013. Jesse spent several years litigating the case both locally, in Broward County Florida and nationally when the litigation resolved for over $1 BILLION (2014; Global Resolution Reached in Lawsuits over Stryker Rejuvenate and ABG II Failed Hips).
Shortly after the Rejuvenate settlement, partner Walter Kelley petitioned for the Stryker V40 hip litigation to be transferred to USDC Judge Talwani in Massachusetts. Walter’s petition was granted and he was appointed co-lead counsel in MDL 2768: In Re: Stryker LFIT V40 Femoral Head Products Liability Litigation. In addition to the above litigations, BDK is currently pursuing cases against almost every hip manufacturer as a result of the defective designs that were carelessly put on the market without adequate testing.
Some of the common cases we screen and pursue include the following hips:
- Biomet (M2A 38mm, M2A Magnum)
- DePuy (ASR, Pinnacle)
- Stryker (Rejuvenate, ABG II, V40 Metal Femoral Head)
- Zimmer (Kinnectiv Hip & Durom Cup)
- Wright (Profemur)
- Smith & Nephew (R3 Acetebular System)
