Client, L.L., is a single father who sustained injuries from a motor vehicle accident in Palm Beach County, Florida. After spending several months with an attorney that LL was not satisfied with, he was referred by a friend to BDK. L.L. required surgery to his neck and back as a result of the crash and knew that he needed a law-firm that had the experience and resources to maximize his recovery and get him his due compensation.
Seasoned BDK litigation attorney, Lou Battista and attorney Alexandra Brady pursued the case for L.L and through their diligent efforts made several impactful discoveries. First they found that at the time of the crash the defendant was driving back from his ophthalmologist appointment and had his eyes dilated. Defendant ran the red light because he could not see the traffic light!
Lou then uncovered that the defendant driver was blind in his left eye and had only “pinhole” vision in his right eye due to glaucoma. After review of the Defendant driver’s medical records, Lou and his medical expert further confirmed that he lacked acuity and peripheral vision requirements to even operate a vehicle under Florida driving laws. The defendant was aware of his poor vision and ignored numerous warnings from his doctors that his ocular health was seriously compromised, and he needed surgery to preserve what little vision that remained in his ‘good’ right eye.
Based on this evidence, the court granted Lou’s motion to bring a claim for punitive damages against the Defendant. The punitive damages claim created the significant pressure needed to settle the case for another satisfied BDK client. The settlement amount was approximately 33 percent more than the total amount demanded by L.L’s previous attorney.
